• Article 1 – PURPOSE OF THE T&CS

These General Terms and Conditions of Sale (hereinafter referred to as the "General Terms and Conditions" or T&Cs) govern the terms and conditions of distance selling between any site user (" minifundi.coffee") wishing to make a purchase on the website " minifundi.coffee(hereinafter referred to as "the purchaser") and the sole proprietorship of Hugo MATHEU, the trademark registrant Minifundi Coffee (hereinafter referred to as " Minifundi »).

The purchase of a product on the site implies an unreserved acceptance by the buyer of the conditions of sale in force on the date of the order.

The latter will not be able to rely on any other general or specific conditions.

Minifundi considers that by validating the order, the buyer has read the general terms and conditions of sale and accepts them without reservation.

• Article 2 – THE PRODUCTS

The products offered are those that appear on the "shop" of the site and are available within the limits of the mentioned stocks.

The photographs of the products on the site are intended to be as faithful as possible, but Minifundi cannot assure you of a perfect similarity.

 

• Article 3 – PRICES

The prices of our products are indicated in euros (VAT not applicable under article 293 B of the General Tax Code). Prices do not take into account shipping costs which will be shown in addition to the price at checkout.

Minifundi reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of registration of the orders, subject to availability.

In case of order to a country other than metropolitan France and Europe, any customs fees or local taxes will be the responsibility of the buyer. They are his sole responsibility, both in terms of declarations and payment to the competent authorities and bodies in his country. It is the responsibility of the buyer to find out about this without being able to demand that Minifundi shall inform him of the amount of taxes and customs duties in his country.

 

• Article 4 – PAYMENT METHOD

The payment of the order is made by credit card via our partner Stripe or via PayPal. To benefit from this payment method, the buyer does not necessarily have to have an account with the company PayPal. In case of payment by PayPal, My Bag includes the commission fees and the general terms and conditions of use of PayPal apply. The order confirmed by Minifundi will only be effective as of the approval of the bank payment centres. In case of refusal by the bank, the order will be automatically suspended and Minifundi will take care to notify the buyer by email. Furthermore Minifundi reserves the right to refuse any order from a buyer with whom there is a dispute.

 

• Article 5 – PAYMENT SECURITY

Minifundi uses the SSL (Secure Socket Layer) security system, which consists of effectively encrypting all banking information with software.
No third party has access to confidential payment information. As a result, the bank details of the member, wishing to make purchases by credit card, will be required for each new order. In any case and following a payment on minifundi.coffee, Minifundi does not store or collect its customers' confidential banking data. The credit/debit card number is never stored.
Only partner banking institutions: Stripe and PayPal keep card numbers.
In addition, Stripe and PayPal have the most effective fraud control, alert and blocking modules on the market, thus protecting all confidential data related to the payment method.

 

• Article 6 – DELIVERY AND DEADLINES

The products are sent to the delivery address that the buyer has indicated on the order form. The times shown will be the usual average times and correspond to the processing and delivery times. Average time between 2 and 5 working days for France and 5 to 7 working days for the World. Minifundi cannot be held responsible for the consequences due to a delay in delivery, or a delay due to a total or partial strike of the postal services. Any order not shipped within 3O days of the order is cancelled unless otherwise stipulated and announced in the offer of sale. In case of delay, an email will be sent to you.

The products are delivered worldwide. No deliveries can be made to a hotel address or PO Box.

 

• Article 7 – SHIPMENTS

In metropolitan France, Corsica and Monaco, shipping is done by Letter Followed by Post: the tracking number allows the buyer to track the shipment and delivery is normally done within twenty-four to seventy-two hours. Any failure to exceed this indicative deadline will not give rise to damages, withholding or cancellation of the order by the buyer. 

Worldwide, shipping is done by International Tracked Letter or via Delivengo, a postal service (tracked to the destination country for some countries and to the border for other destinations).

Under no circumstances can GUILA be held responsible for any delivery problems. No refund request will be accepted. As soon as the order has left GUILA's premises and has been handed over to the carrier, the risks are borne by the buyer. This is because the product has become the property of the buyer as of the perfect payment. In the event of damage during transport, a reasoned complaint must be lodged with the carrier (check with the carrier for instructions on how to take action).

 

• Article 8 – RECEIPT OF PRODUCTS

Upon receipt of the order, the buyer must immediately check the condition of the packaging and the delivered product.

If, at the time of delivery, the packaging is damaged, torn or opened, then the buyer must check the condition of the products it contains. In the event of a problem, the buyer has 2 working days to inform customer service by email ( contact@bobtoolbox.fr) and by post with acknowledgement of receipt to (Minifundi, 22 rue Bonnefoy 31500 Toulouse, France).

Similarly, the buyer always has the right of withdrawal under the conditions of article 8 below.

 

• Article 11 – DISPUTE RESOLUTION

In the event of a disagreement, the buyer must contact the Customer Service of Minifundi by sending your written complaint by email to: contact@guila.paris to find an amicable solution.

In accordance with Article L.612-1 of the French Consumer Code and in the absence of a solution within 21 days of the order, the Client may refer the matter to the SAS Mediation Solution Commission, 222 chemin de la bergerie, 01800 Saint Jean de Niost, tel: 04 82 53 93 06, E-mail: contact@sasmediationsolution-conso.fr which will seek an amicable settlement free of charge. The Commission has exclusive jurisdiction to deal with disputes arising between the two parties in a mediation process. Minifundi and the buyer.

In addition, the responsibility of Minifundi, under these terms and conditions, shall not exceed a sum equal to the sums paid or payable in connection with the transaction giving rise to such liability, regardless of the cause or form of the action concerned.

 

• Article 12 – APPLICABLE LAW

This contract is subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.

 

• Article 13 – INTELLECTUAL PROPERTY

The use of the website "minifudi.coffee is strictly for personal use only.

Items belonging to Minifundi such as the website, trademarks, designs, images, texts and the design of the product are its exclusive property.

These T&Cs do not imply any transfer of intellectual property rights over the elements belonging to Minifundi (photographs, images, literary texts, artistic works, software, trademarks, logos, etc.) for the benefit of the purchaser.

Any simple or hypertext link is strictly prohibited without the written consent of Minifundi.

The buyer shall not directly or indirectly infringe the property rights of Minifundi. Visitors to the site or purchasers agree not to reproduce or distribute all or part of the site without the written consent of Minifundi.

Any reproduction or representation, without the written consent of Minifundi, constitutes an infringement that may incur the civil and criminal liability of its author.

 

• Article 14 – PRIVACY POLICY AND PERSONAL DATA

Minifundi undertakes not to disclose to third parties the information that the buyer communicates to him when placing his order. It is confidential and will only be used for the processing of your order and for the sending of commercial information relating to your Minifundi.

In accordance with Law No. 78-17 of 6 January 1978 relating to Data Processing, Files and Civil Liberties, the buyer has the right to access, modify and delete his personal data by writing, by post and providing proof of his identity, to Minifundi, 22 rue Bonnefoy, 31500 Toulouse, France.
